    A friend and i are thinking about starting a small fast food delivery business, we are wondering about what legal steps are necessary in order to get the business fully up and running. Thanks in advance!

    p.s. or is it possible to just take cash and not through the trouble of starting a business.

    FoodDudes, your p.s. seems to indicate that you don't really understand what you are asking. Once you take any step to engage in a profit-making activity, whether by yourself or with someone else, you have "started a business." Even a small sole proprietorship is a business. Depending on the type of business, there may have to be steps taken for even the smallest business. For example, although it became a viral media issue, the authorities in one town shut down a couple of young girls selling homemade cupcakes because they didn't have a license from the health department.

    For many small businesses, no legal steps are "necessary." There may be legal steps that are recommended, such as forming a legal entity separate from the owners. If you are operating as a general partnership (that is, no corporation or LLC), you would normally need to comply with your state's requirements for operating with an assumed business name. If you have employees, there are more requirements such as filing with your state's departments of employment security (for unemployment insurance) and revenue (for employment tax withholding). It all depends on what you are doing.

    Definitely check-into the laws concerning food related businesses in your municipality as they can differ from place-to-place.

    I think before starting a new business you should work for someone who are experienced in this stuff. when you gain knowledge about this business, then think about a business plan .
